Am 18.März wurde Ojub Titiev vom Stadtgericht Schali in Tschetschenien zu vier Jahren Freiheitsentzug verurteilt.

Ich bin zutiefst besorgt über die Verurteilung von Ojub Titijew, Träger des deutsch-französischen Preises für Menschenrechte und Rechtsstaatlichkeit. Die Zweifel an den Vorwürfen und an der Rechtsstaatlichkeit des Verfahrens sind gut dokumentiert und auch im OSZE-Bericht zur Menschenrechtslage in Tschetschenien beschrieben. Ich fordere Russland auf, den darin enthaltenen Empfehlungen zu folgen: Das Urteil und die Untersuchungshaft sollten schnellstens von einem Gericht außerhalb Tschetscheniens überprüft, Ojub Titijew aus der Untersuchungshaft freigelassen werden. Russland muss gewährleisten, dass Menschenrechtsverteidiger ohne Angst vor Strafverfolgung auch in Tschetschenien tätig sein können.

We believe that the sentencing of Oyub Titiev is directly connected to his human rights work for Memorial, an organisation that has been the subject of ongoing intimidation and harassment in the North Caucasus and beyond. We also believe that Mr Titiev has not received a fair trial. His sentencing continues a trend of arrests, attacks and discrediting of human rights defenders and journalists who work in that region of the Russian Federation. Mr Titiev's predecessor as head of Memorial in Chechnya, Ms Natalia Estemirova, was killed in 2009 and, almost ten years later, not a single person has yet been brought to justice for this crime. The European Union expects Mr Titiev to be released immediately and unconditionally.

Frankreich behält seine Forderung nach einem fairen Prozess für Herrn Titiev in sämtlichen Phasen des Verfahrens bei und ruft Russland nach wie vor dazu auf, die Empfehlungen im OSZE-Bericht hinsichtlich der Menschenrechtslage in Tschetschenien gemäß seinen eingegangenen internationalen und europäischen Verpflichtungen umzusetzen.

DRA (Deutsch-Russischer Austausch e.V.)

Der DRA fordert die russischen Justizbehörden dazu auf, das Urteil in höh(eren Instanzen unabhängig überprüfen zu lassen, die Rechtsverstöße während der Festnahme, der Untersuchungshaft und des Gerichtsverfahrens aktiv zur Kenntnis zu nehmen, sie bei den Revisionsverfahren juristisch entsprechend entlastend zu bewerten und Oyub Titiev freizulassen sowie zu rehabilitieren und zu entschädigen. Zudem muss die freie Arbeit von Menschenrechtsaktivist*innen landesweit auch in Russland gemäß den einschlägigen internationalen Konventionen und Vereinbarungen ungehindert möglich und gesichert sein, darunter in allen Republiken des Nordkaukasus.

The case against him gave every impression of having been fabricated in retaliation for his exposure of appalling human rights violations, his trial was blatantly unfair and the sentence is absurdly disproportionate to the alleged offence. Rather than proving that Mr Titiev is a criminal, this sorry episode merely proves once again that the Chechen police and judiciary are political tools in the hands of the regional authorities. He should be released immediately.

The conviction of Oyub Titiev is but the latest example of the hostile and dangerous environment in which human rights defenders operate in the Chechen Republic. This has a broader negative impact on the human rights situation in the region. I once again urge the authorities of the Russian Federation to uphold their obligations and ensure that the judicial system is not used to harass human rights defenders. I will again raise this issue with the Russian authorities as a matter of urgency.

Criminalization of people seeking observance of laws an international standards is a sign of weakness. Czech Republic protests against the imprisonment of #Oyub Titiev who was awarded in 2018 by the Parliamentary Assembly of the Council of Europe with the #VaclavHavelHumanRightsPrize and repeatedly calls on Russian Federation to release him immediately.

Amnesty Internationals

Was zu befürchten war, ist eingetreten. Heute hat das Stadtgericht von Schlali in Tschetschenien umgesetzt, was Ramsan Achmatowitsch Kadyrow, Präsident der russischen Teilrepublik, von ihm erwartet hat: Das Gericht hat den Menschenrechtler wegen unerlaubten Drogenbesitzes zu einer mehrjährigen Freiheitsstrafe verurteilt. Das Gericht hat keine Entlastungsbeweise zugelassen, aus denen sich eindeutige Hinweise hätten ergeben können, dass Titiev die Drogen bei einer Polizeikontrolle untergeschoben worden waren. Überaus zweifelhaften Belastungszeugen hat es dagegen geglaubt. Fast zehn Jahre ist es inzwischen her, dass die Menschenrechtlerin Natalja Estemirowa, die in Tschetschenien ebenfalls für Memorial gearbeitet hatte, Opfer eines nie aufgeklärten Mordes wurde. Mit dem heutigen Urteil beenden Polizei und Justiz nun die Arbeit ihres Kollegen Titiev.

We are not surprised by the conviction, as it underlines the absence of fundamental human rights and the unjust court system in Chechnya. Titiev’s case is political motivated and the evidence fabricated. He should never have been arrested in the first place, and the authorities should immediately release him. We encourage the prime minister to raise the issue of the conviction of Titiev to her Russian colleagues. Norwegian and politicians from other democratic countries need to put human rights as a priority in dialogues with Russian authorities, as human rights activists, lawyers and journalists are threatened, arrested and even killed.

Civil Rights Defenders

The trial was absurd from beginning to end, and there is no illusion that Oyub will be released. Ramzan Kadyrov, the head of the Chechen Republic, had already stated publicly that Titiev was guilty. In Chechnya, where an independent judiciary is non-existent, there was little hope that the judge would try to establish the truth. This verdict is a blow against the few remaining human rights defenders and will, in many ways, give the regime greater space to persecute and harass its citizens. Civil Rights Defenders denounce the sentence against Oyub Titiev and demand him to be immediately freed, charges dropped and sentence quashed.

The Right Livelihood Award

The trial against Oyub Titiev has been a farce from day one. It’s not every day that you come across such a well-documented case of a political trial based on trumped up charges. We urge the Russian authorities to unconditionally release Oyub Titiev straightaway, drop all charges against him, cease the harassment of Memorial’s staff, and guarantee accountability for the attacks against Memorial’s workers and offices.

Gemeinsame Pressemitteilung FIDH (International Federation for Human Rights) , OMCT (World Organisation Against Torture) und IPHR (International Partnership for Human Rights)

FIDH and OMCT, under the Observatory for the Protection of Human Rights Defenders, together with IPHR, unequivocally condemn today’s conviction of Oyub Titiev by the Shali City Court for possession of marijuana on an especially large scale. The criminal proceedings against Mr. Titiev, detained since his arrest on January 9, 2018, constitute a mockery of justice and serve the sole purpose of humiliating and punishing Titiev for his human rights activities. Today’s ruling, which was observed by the Observatory and IPHR, also delivers a dire warning to other human rights defenders either to remain silent or face the consequences. It is appalling how a local court could sentence a high-profile defender in breach of every possible fair trial standard, despite huge attention locally and internationally. One can only imagine what does administration of justice look like in 'ordinary' cases that attract no attention.
